Template notice: These terms are a starting point. Because your business involves trading in real estate in Ontario, have a qualified Ontario lawyer (and your brokerage's compliance) review them to confirm they accurately reflect your services, your registration under TRESA/RECO, and how you are compensated.

These Terms of Use ("Terms") govern your access to and use of the Southern Ontario Apartment Investor Network website and services ("SOAIN", the "Service"), operated by Bruh Tesfatsion Real Estate. By accessing the site or joining the network, you agree to these Terms. If you do not agree, please do not use the Service.

1. Nature of the Service

SOAIN is a private network that provides market information and connects qualified investors with apartment-building opportunities in Southern Ontario. Membership is free. The Service provides information and introductions; it does not itself constitute an offer to sell or a solicitation of an offer to buy any property or security.

2. Not investment, financial, legal, or tax advice

All content, market data, cap-rate figures, underwriting summaries, and opinions provided through the Service are for informational purposes only and do not constitute investment, financial, legal, accounting, or tax advice. We are not your financial advisor. We do not guarantee any returns. Real estate investing involves risk, including the possible loss of capital. You are solely responsible for conducting your own due diligence and for obtaining independent professional advice before making any investment decision.

3. Deal information and examples

Any deals, pricing, cap rates, or returns referenced on the public site or in marketing are illustrative and/or anonymized unless expressly stated otherwise. Specific opportunities shared with members are subject to verification, change, and availability, and may require a separate confidentiality agreement before financial details are disclosed.

4. Real estate services and registration

Any trade in real estate facilitated in connection with the Service is conducted in accordance with applicable Ontario law, including the Trust in Real Estate Services Act, 2020 (TRESA) and the rules of the Real Estate Council of Ontario (RECO). Services are provided by Bruh Tesfatsion, a Sales Representative registered with the brokerage Peakhill Realty under RECO registration #5018048. Compensation is commission-based. No agency, brokerage, or fiduciary relationship is created by your use of the site; any such relationship arises only under a separate written agreement and through the brokerage.

5. Eligibility and accurate information

The Service is intended for serious real estate investors and related professionals. You agree to provide accurate, current, and complete information in your application and to keep it updated. We may decline, suspend, or remove any membership at our discretion.

6. Member confidentiality

Opportunities, financials, and seller information shared through the network are confidential. You agree not to disclose, distribute, or use such information except for the purpose of evaluating the specific opportunity, and to comply with any confidentiality agreement applicable to a given deal.

7. Intellectual property

The site, its content, branding, market reports, and underwriting materials are owned by or licensed to Bruh Tesfatsion Real Estate and are protected by applicable laws. You may not copy, reproduce, or distribute them without our written permission, except for your own internal evaluation of opportunities.

8. Limitation of liability

To the fullest extent permitted by law, Bruh Tesfatsion Real Estate and its representatives are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service or reliance on any information provided. The Service is provided "as is" without warranties of any kind.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your information.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts of Ontario.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
